1. Program Description

HonorCall Marketing ("COMPANY," "we," "us," or "our") is a performance-based lead generation agency serving independent, non-medical home care agencies across the United States. We help home care agencies connect with families actively searching for companion care, personal care, dementia care, overnight care, post-surgery support, and respite care services.

This messaging program sends SMS/text messages to individuals who have opted in to receive communications from HonorCall Marketing through our website at honorcallmarketing.com, via our scheduling forms, or through other consent collection methods. Messages may include:

- Appointment confirmations and reminders

- Strategy call scheduling and rescheduling updates

- Service inquiry follow-ups

- Campaign performance notifications (for agency clients)

- Missed-call recovery texts (sent when an agency misses an inbound family call)

- Account alerts and billing notifications

- Customer support communications

Opt-in is collected explicitly via web forms with a dedicated checkbox for SMS consent, keyword texting, verbal consent during a call, or written consent on a physical or digital form. We maintain timestamped records of all opt-in actions including the method, date, time, and specific program(s) consented to.

Opting in to receive text messages is NOT a condition of purchasing any goods or services.

2. Consent & Opt-In

By opting in to our SMS program, you expressly consent to receive recurring text messages from HonorCall Marketing at the phone number you provided. You confirm that:

- You are the owner or authorized user of the mobile device and phone number provided

- You have voluntarily opted in to receive text messages from us

- You understand that consent is not required as a condition of any purchase or service

- You are at least 18 years of age

We comply with the Telephone Consumer Protection Act (TCPA), the CAN-SPAM Act, CTIA guidelines, and all applicable federal, state, and local laws governing electronic communications.

3. Cancellation / Opt-Out Instructions

You can cancel the SMS service at any time. Simply text "STOP" to the same number that sent you messages. Upon sending "STOP," we will send a final confirmation message acknowledging your opt-out. Following this confirmation, you will no longer receive SMS messages from us unless you re-opt in.

All opt-out requests are processed immediately and no later than within 24 hours.

5. Message Frequency

Message frequency varies based on your interactions with our business and the services you have requested. Typical frequency is 1–10 messages per month, depending on appointment activity, campaign status, and account communications.

We do not send unsolicited promotional or marketing content without your specific, prior consent.

6. Message & Data Rates

Standard message and data rates may apply for messages sent to you from us and to us from you, depending on your mobile carrier and plan. For questions about your text plan or data plan, contact your wireless provider.

7. Carrier Liability

Carriers are not liable for delayed or undelivered messages. Service availability may vary by carrier and coverage area.

8. Supported Carriers

Our SMS program works with all major U.S. wireless carriers, including but not limited to: AT&T, T-Mobile, Verizon, Sprint, U.S. Cellular, and most regional and prepaid carriers.

9. Age Restriction

You must be 18 years or older to participate in our SMS program.

10. SMS Data Protection

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Information sharing with subcontractors in support of service delivery (such as SMS aggregators and platform providers solely for the purpose of delivering messages you have consented to receive) is permitted.

All other use case categories exclude text messaging originator opt-in data and consent; this information will not be shared with any third parties.

We implement strict technical and organizational data protection measures to safeguard your SMS opt-in information, phone numbers, and consent records, including encryption, access controls, and regular security audits.

12. Acceptance of Terms

This website (the "Site") is owned and operated by HonorCall Marketing LLC ("COMPANY," "we," or "us"), a performance-based lead generation agency specializing in connecting independent, non-medical home care agencies with families actively seeking companion care, personal care, dementia care, overnight care, post-surgery support, and respite care services.

By accessing or using the Site, in any manner, whether automated or otherwise, you agree to be bound by these Terms of Service and to use the Site in accordance with these Terms of Service, our Privacy Policy, and any additional terms and conditions that may apply to specific sections of the Site or to products and services available through the Site or from HonorCall Marketing.

We reserve the right to change these Terms of Service or impose new conditions on the use of the Site from time to time, in which case we will post the revised Terms of Service on this website with an updated effective date. By continuing to use the Site after we post any such changes, you accept the Terms of Service, as modified.

13. Description of Services

HonorCall Marketing provides the following services to independent, non-medical home care agencies:

- Performance-based lead generation through Google and Facebook advertising

- Exclusive, one-agency-per-zip-code territory protection

- Call tracking, recording, and transcription for lead qualification

- Missed-call recovery via automated SMS

- Google Business Profile optimization and reputation management

- Client reporting and analytics

Our services are designed exclusively for independent, owner-operated home care agencies. We do not serve franchise chains, staffing agencies, or medical/skilled home health agencies.

14. Performance-Based Billing

HonorCall Marketing operates on a performance-based pricing model. Agency clients are billed only for qualified family calls that meet all of the following criteria:

- The caller is a family member, spouse, or individual seeking non-medical home care services

- The caller is the decision-maker or someone directly involved in arranging care

- The caller is located within the agency's defined service area

- The call lasts 45 seconds or longer

- The caller is NOT seeking employment, caregiver jobs, or medical/skilled nursing services

Calls that do not meet these criteria are not billed. All calls are recorded, transcribed, and available for client review. Full transparency is maintained at all times.

15. Intellectual Property Rights

Our Limited License to You

This Site and all materials available on it are the property of HonorCall Marketing and/or our affiliates or licensors and are protected by copyright, trademark, and other intellectual property laws. The Site is provided solely for your personal, non-commercial use.

You may not use the Site or the materials available on the Site in a manner that constitutes an infringement of our rights or that has not been authorized by us.

Unless explicitly authorized, you may not modify, copy, reproduce, republish, upload, post, transmit, translate, sell, create derivative works, exploit, or distribute in any manner or medium any material from the Site. However, you may download and/or print one copy of individual pages for your personal, non-commercial use, provided you keep intact all copyright and proprietary notices.

Your License to Us

By posting or submitting any material (including comments, blog entries, social media posts, photos, and videos) to us via the Site or other digital venues, you represent that you own the material or have the necessary permissions. You grant us a royalty-free, perpetual, irrevocable, non-exclusive, worldwide license to use, modify, transmit, sell, exploit, create derivative works from, distribute, and publicly perform or display such material.

16. Call Recording & Transcription Disclosure

As part of our lead generation services for non-medical home care agencies, we record and transcribe inbound calls for the following purposes:

- Lead qualification: Determining whether a call meets our qualified family call criteria

- Quality assurance: Ensuring high-quality service delivery

- Billing accuracy: Verifying that only qualified calls are billed to our agency clients

- Performance reporting: Providing transparent call data and analytics to our clients

Call recordings and transcriptions are stored securely and accessible only to authorized personnel and the relevant agency client. Callers are notified of recording in accordance with applicable state and federal laws.

17. Disclaimers

We may provide links to third-party Internet sites. Linking to such sites does not imply endorsement or sponsorship of them or their content.

The information, products, and services offered on or through the Site are provided "as is" and without warranties of any kind. To the fullest extent permissible under applicable law, we disclaim all warranties, including implied warranties of merchantability and fitness for a particular purpose.

You agree at all times to indemnify and hold harmless HonorCall Marketing, its affiliates, and their officers, directors, agents, and employees from any claims, damages, liabilities, costs, or expenses arising from your breach of any obligation or representation under these Terms of Service.

HonorCall Marketing does not guarantee specific results from our lead generation services. While we provide qualified family calls, the conversion of those calls into paying clients depends on the agency's own sales process, responsiveness, and service quality.

18. Online Commerce

Some parts of the Site may allow you to purchase products and services from third-party vendors. We are not responsible for the quality, accuracy, timeliness, reliability, or any other aspect of these products and services.

If you purchase from a third party linked through the Site, your information, including payment details, may be collected by both the merchant and us.

Your interaction with third-party vendors is solely between you and the vendor. HonorCall Marketing is not responsible for any loss or damage incurred as a result of such dealings.

19. Registration & Passwords

To access certain features, you may need to create an account. You agree to provide accurate, current information during registration. You are responsible for maintaining the confidentiality of your login details and for all activities under your account.

20. Territory Exclusivity

HonorCall Marketing operates on a one-agency-per-zip-code exclusivity model. Once an agency is enrolled in a specific zip code, no competing agency may engage HonorCall Marketing's services in that same zip code. Exclusivity is maintained for the duration of the active service agreement. Territory assignments are non-transferable without written consent from HonorCall Marketing.

21. Termination

We may terminate or suspend your access to the Site or our services without notice if we determine that you have violated these Terms of Service or engaged in inappropriate or unlawful conduct.

Agency clients may cancel services on a month-to-month basis after the initial 60-day guarantee period. Upon termination, the agency's zip-code exclusivity is released and may be offered to another agency.

Upon termination, you must stop using the Site and all content obtained from it.

22. Limitation of Liability

To the maximum extent permitted by law, HonorCall Marketing shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising out of or relating to your use of our services or this Site, even if we have been advised of the possibility of such damages. Our total liability shall not exceed the amount you paid to us in the twelve (12) months preceding the event giving rise to the claim.

23. Governing Law

These Terms of Service are governed by the laws of the State of Wyoming (the state in which HonorCall Marketing LLC is registered). Any dispute arising out of or relating to these Terms shall be resolved exclusively through binding arbitration in Wyoming, in accordance with the rules of the American Arbitration Association.

24. Changes to Terms of Service

We may update these Terms periodically to reflect changes in our practices, services, legal requirements, or other factors. The latest version will always be available on our website with the updated effective date. For significant changes, we will notify affected parties by email or through a prominent notice on our website.
